Terms of use
1. The add-in and the service
PowerCAPEX for Excel ("the add-in") is provided free of charge by KPMO as an accessory to the PowerCAPEX service. Use of the add-in requires a PowerCAPEX portal account. Your use of PowerCAPEX, including data you access through the add-in, is governed by the PowerCAPEX agreement between KPMO and the organisation that owns your project ("the client agreement"). Where these terms and the client agreement differ, the client agreement prevails.
2. Licence
KPMO grants you a personal, non-exclusive, non-transferable licence to install and use the add-in with Microsoft Excel for the purpose of working with the project data you are authorised to access. You may not reverse engineer, resell or redistribute the add-in, or use it to access data you are not authorised to see.
3. Your account
You are responsible for keeping your PowerCAPEX account (your Microsoft account or the username and password KPMO issued to you) secure and for what is done with the add-in under it. Access is granted, changed and withdrawn by KPMO at the request of the project owner and may end at any time.
4. Data
Tables the add-in inserts are copies of project data as at the time of insertion or refresh. Once in your workbook they are under your control and your responsibility; keep them in line with the client agreement and your organisation's policies. Our handling of personal information is described in the privacy policy.
5. Availability and changes
The add-in depends on the PowerCAPEX portal, Microsoft Excel and Microsoft cloud services. We may change, add or retire tables, and update or withdraw the add-in, at any time. We aim to give notice of changes that affect existing workbooks through the add-in itself.
6. Warranty and liability
The add-in is provided "as is" for use with the PowerCAPEX service. To the extent permitted by law, KPMO excludes all warranties not set out in the client agreement and is not liable for loss arising from use of the add-in beyond what the client agreement provides. Nothing in these terms limits rights that cannot be limited under New Zealand law.
7. Governing law
These terms are governed by the laws of New Zealand.
